“BATHROOMS AND MORE” - TERMS & CONDITIONS
- Bathrooms and More Programme (Programme) is a benefits programme only available to family, friends and associates of GWA Group. In these terms and conditions, “we”, “us”, “our” and “GWA” refers to Caroma Industries Pty Ltd. To receive the entitlements of the Bathrooms and More Programme, you agree to these Bathrooms and More Programme terms and conditions as amended by GWA from time to time.
- In these terms and conditions:

- "Order" means an order for Products.
- "Price" means the discounted price offered to you on the Programme Store for a Product, plus shipping costs at the time you place an Order.
- "Product" means a product GWA makes available for Order through the Programme Store.
- "Programme Store" means the online store for the Programme at www.bathroomsandmore.com.au.
PROGRAMME ELIGIBILITY
3. To be eligible for the Programme, you must be:
-
- an employee of GWA Group Limited, or one of its subsidiaries in Australia or New Zealand
-
a referral, invited by an employee of GWA Group Limited.
- an employee of a company regarded as a friend or associate of GWA.
4. Additionally, you must:
-
- be 18 years of age or older;
- complete the registration process by following the link sent to you and providing your information; and
-
have GWA confirm your membership has been approved.
5. Membership and benefits are for individuals only. Corporations, partnerships, trusts and other entities are not eligible to be members or otherwise participate in the Programme.
6. GWA reserves the right to refuse anyone membership or remove anyone at any time from the Programme (including individuals who meet eligibility criteria).
PROGRAMME ENTITLEMENTS
7. Members of the Programme are entitled to the following entitlements:
- a discount off the recommended retail price of Products available on the Programme Store from time to time; and
- special offers promoted from time to time to purchase Products from the Programme Store which may apply instead of, or in addition to, Programme membership discount.
8. Programme entitlements:

may be subject to additional terms and conditions stipulated on the Programme Store in relation to a specific Product;
-
may not be redeemed in conjunction with any other offers in respect of a Product; and
- are only available for purchases through the Programme Store and are not available when purchasing GWA products in-store or from a third party,whether online or in-store.
9. There is no obligation on members of the Programme to purchase Products from the Programme Store.
ORDERS
10. You may order Products by submitting an Order through the Programme Store. Each Order is an offer by you to purchase the Products specified in the Order. All Orders are subject to acceptance by GWA.
11. You may place Orders on behalf of family and friends using your Programme Store account provided that they are billed to your Billing Address (but may have a different delivery address).
12. You are limited to 6 Orders per calendar year, with a maximum of 50 items per Order.
13. For some Products, there may be a limit on the number of the Product that can be purchased in a single Order.
14. When placing an Order you must use your email address and password to log in to your Programme Store account. You may not use another person's email address and password.
15. It is a requirement of the Programme that you only purchase Products for personal use and any Products purchased cannot be on-sold or used for any commercial purpose.
16. GWA may refuse or cancel any Order at its discretion, including because there is an error in the Order or the information on the Programme Store, or due to unavailability of a Product.
PAYMENT
17. Your Price for a Product will be as specified in the Programme Store.
18. Delivery charges may apply and will be added to your total order prior to payment.
19. Unless otherwise indicated, Prices are in Australian dollars and include GST.
20. Any delivery charges or extra packaging charges that are payable by you will be displayed and included at checkout.
21. Payment must be made at the time of placing the Order.The payment methods, including credit cards GWA accepts, are as provided on the Programme Store.
22. If you pay by credit card, the Price will be charged to your credit card when the Product is shipped.
DELIVERY
23. Orders for Products cannot be suspended or cancelled except with GWA's consent. You will be responsible for payment of all reasonable expenses incurred by us due to suspension or cancellation.
24. Delivery dates are estimates only and we are not liable for any loss or damage for failure to deliver by those dates.
25. GWA may deliver an Order in multiple deliveries.

WARRANTY
27. For a Product sold through the Programme Site, the applicable individual Product warranty as stated on the warranty card included with the Product applies. Details of GWA warranties are also available at https://bathroomsandmore.com.au/warranty/
28. Subject to clause 29, any condition or warranty which would otherwise be implied in these terms and conditions whether by statute or otherwise is excluded.
29. Where legislation implies in these terms and conditions any condition or warranty, and that legislation avoids or prohibits provisions in a contract excluding or modifying the application of or exercise of or liability under the condition or warranty, the condition or warranty is deemed to be included in these terms and conditions. However, the liability of GWA for any breach of the condition or warranty is limited in the manner set out in clause 35.
30. If a Product needs to be installed by a plumber or other licensed tradesperson, that Product must be installed by an appropriately licensed person. GWA is not responsible for any loss or damage or failure to meet a warranty or consumer guarantee to the extent the issue has arisen because a Product has not been correctly installed.
VARIATION AND TERMINATION
31. You acknowledge that the provision of the Programme is at the complete discretion of GWA and that GWA may at any time:
- change, suspend or terminate all or part of the Programme;
- suspend or terminate your membership of the Programme;
- vary the entitlements available under the Programme;
- place restrictions or limits on the entitlements, including but not limited to the number of Products that may be purchased in an Order.
32. GWA will use all reasonable efforts to communicate to you any restrictions, limits or changes to the Programme on the Programme Store.
33. You agree that GWA does not need to notify you in advance, or give you any reasons, with regard to any action GWA takes concerning the Programme or your use of it.
34. You agree that you have no entitlement to and GWA is not liable for, any loss or damage suffered by you from any termination or variation to the Programme, except for any liability which cannot be excluded by law.
LIABILITY
35. The liability of GWA in contract, tort, statute or otherwise in connection with the Programme Store or the supply of a Product, including for any noncompliance with a warranty under these terms and conditions or a guarantee under the Australian Consumer Law (other than a guarantee for which liability cannot be limited) is:
- limited at the option of GWA to one or more of the following:
-
if a breach relates to goods:
- the replacement of the goods or the supply of equivalent goods;
- the repair of the goods;
- payment of the cost of replacing the goods or of acquiring equivalent goods; or
- the payment of the cost of having the goods repaired; and
- ii. if the breach relates to services:
- the supplying of the services again; or
- the payment of the cost of having the services supplied again; and
b. excludes any special, incidental, indirect, exemplary, punitive or consequential damages (including without limitation, loss of profit, loss of opportunity and loss of goodwill) incurred by you either directly or indirectly.
PRIVACY AND PERSONAL INFORMATION
36. We will communicate with you by email to send you reminders concerning your membership. It is your responsibility to provide GWA with your correct personal details, including any changes to them. GWA accepts no responsibility for a member not receiving any GWA communications if incorrect details are provided, or GWA is not notified of any change.
37. GWA collects, uses, discloses and stores your personal information for the purpose of providing you with your membership, without which we couldn’t do so.
38. GWA may disclose your information to its related companies and third-party providers in order to assist us in providing you with Products, which may include disclosure overseas.
39. You are able to access the information held by GWA, and seek the correction of such information, by contacting us. The GWA Privacy Policycontains additional information with respect to how we manage your personal information, including how to access and correct your information or make a complaint. 40. If you agree when registering, GWA will send you marketing material concerning special offers, product information and other information relating GWA. You can opt out of receiving marketing material at any time.
GENERAL
41. This Agreement constitutes the entire agreement between you and GWA concerning your use of the GWA Programme site and sales made to you through the GWA Programme site, and supersedes any prior written or other agreement between you and GWA.
42. If any part of this Agreement is or becomes illegal, void or unenforceable, this does not invalidate the rest of this Agreement.
43. These terms and conditions are governed by and must be construed according to the law applying in New South Wales. You irrevocably:
- submit to the nonexclusive jurisdiction of the courts of New South Wales, and the courts competent to determine appeals from those courts, with respect to any proceedings that may be brought at any time relating to these terms and conditions; and
- waive any objection you may now or in the future have to the venue of any proceedings, and any claim it may now or in the future have that any proceedings have been brought in an inconvenient forum.
44. In theseterms and conditions:

headings are for convenience only and do not affect interpretation;

words importing the singular include the plural and vice versa; and
- "includes" in any form is not a word of limitation.

GWA Group Limited Privacy Policy
GWA Group Limited and each of its wholly owned subsidiaries (collectively “GWA”, “we”, “us”, “our”) respect the privacy of information with which we are provided.

If you apply for a job with us then the personal information we collect may include your resume, qualifications, skills, education history, work history and residency status.
We generally do not collect sensitive information, however if we do we will only collect it with your consent.
From time to time, you may be able to visit our website or deal with us anonymously or by pseudonym. However, we require certain personal information to be able to provide you with the services and information you request. If you do not provide us with certain personal information, we may not be able to provide you with access to those services or respond to your request, or we may need to request that personal information at a later time.
If you provide us with personal information about a third party, you represent, and we collect it on the basis that, you have that person’s consent for us to collect and handle their personal information in accordance with this privacy policy.
- How do we collect your personal information?
We may collect personal information from our customers, prospective employees, contractors, individuals from our suppliers or trading partners, and existing or possible consumers of our products and services.

- when you visit our showrooms;
- when you attend events in person;
- when you create an account with us online;
- when you register online for an event or to attend an Experience Centre;
- through application forms on our website;
- online, when you make a purchase from us;
- when you use one of our online portals;
- when you use one of our apps;
- when you respond to a customer or trade survey;
- when you make an enquiry via our websites; or
- when you contact us by telephone or email (eg with product or general enquiries, or regarding a sale or a warranty claim).
We also collect personal information about you when you use our apps and digital tools on your mobile device and our websites. When you do so, the information we collect may include the type of device you are using and information about your usage and in some cases your location.
Where it is reasonable and practicable to do so, GWA will collect personal information directly from you. On occasions, your personal information may be collected from the following third parties:
- companies that sell or distribute our products or white papers;
- organisations that provide information on construction projects, tenders, fit-outs and contracts available in the market;
- companies that provide services to us;
- credit reporting agencies, where we request a credit report for you;
- medical practitioners; and
- previous employers, where you are applying for a job with us.
Where we collect information from a third party, we will notify you that we have collected that information.
- Why do we collect, hold, use and disclose your personal information?
We collect, hold, use and disclose your personal information for the purposes for which we collected it, and for other related purposes that you would reasonably expect. These may include:
- to respond to your enquiries about our products and services, including providing you with the relevant technical information;
- to determine your requirements for our products and services;
- to process your registrations for events and new products;
- to process your appointments with us, including bookings for design consultations;
- to open an account for you, to enable better functionality while using our websites or apps;

In some situations we may collect some additional identity information for the purpose of enabling us to verify your identity (which we may do, for example, when you enter a promotion or make an inquiry over the internet or wish to obtain copies of our price lists or catalogues).

Our websites may use cookies. We do not use the information stored in those cookies to collect personal information about you. The cookies are used for statistical purposes and to assist with your use of our websites. The cookies are not used for any other purposes. - any person to the extent necessary, in our view in order to carry out any instruction you give to us.
- Disclosure of personal information overseas
Any personal information you provide to us, including via our websites or through our applications may be collected, processed and stored by our website service provider and digital agency service provider. Our service providers will collect and process your personal information on our behalf, and disclose it to us so that we may use it for the purposes set out in this policy. This may involve disclosure of your personal information to service providers who are likely to be located in Australia, New Zealand and India.
We also make use of cloud service providers for the purposes of data storage and enterprise management, whose servers may be located in various countries around the world.

We rely on the personal information we hold about you to effectively conduct our business. For this reason, it is important that the information collected is accurate, complete and up to date. We will take reasonable steps to ensure that your information is accurate, up to date and complete.
